Introduction
The present general terms and conditions of sale have been established to comply with the legal framework set by the Consumer Code, as well as that of distance selling and electronic commerce, in accordance with the Law on Confidence in the Digital Economy, No. 2004-575 of June 21, 2004.
They are entered into exclusively between the company B.A.R. Associés, registered with the RCS of Paris under number 430 246 405, with its registered office at 75 Bis Blvd de Clichy, 75009 Paris, hereinafter referred to as Boutique-Rugby.com, and any person visiting or making a purchase through the Boutique-Rugby.com website, hereinafter referred to as the customer or the internet user.
The parties agree that their relationship shall be governed exclusively by these general terms of sale, which are accessible on the Boutique-Rugby.com website. These terms may be subject to modifications. Therefore, it is understood that the applicable conditions are those in force on the website at the time of the contract. Finally, these general terms of sale define the sales terms between Boutique-Rugby.com and the internet user. They regulate the various steps to follow to place an order on this site. ARTICLE 1 - CONTRACT
The internet user declares to be 18 years old and to have legal capacity to contract on our website Boutique-Rugby.com, as well as to comply with these general terms of sale or to have parental authorization allowing them to place an order on the Boutique-Rugby.com website.
The placing of your order is done in several steps: - the internet user chooses their products, - the internet user enters their personal information, - the internet user selects their payment method, - the internet user confirms their order, - the internet user receives an email confirming their order.
The order confirmation email signifies the acceptance by Boutique-Rugby.com of the internet user's order and thus forms the sales contract between the parties.
The online provision of the credit card number or the cashing of the check or bank transfer by B.A.R. Associés and the final validation of the order constitute proof of the entirety of the order. This validation serves as a signature and acceptance of all transactions conducted on the site by the internet user.
In the case of an order exceeding €200, as well as in the context of anti-fraud checks aimed at securing its customers' transactions, Boutique-Rugby.com shall be entitled to request the internet user to provide one or more proof of residence documents before validating the order. The order will only be final upon receipt of these documents by Boutique-Rugby.com. In the absence of the receipt of these documents or if they do not allow for the certain identification of the author of the order and the reality of their residence, Boutique-Rugby.com reserves the right not to accept the order.
Boutique-Rugby.com reserves the right to refuse an order if there is a current dispute or an abnormally high order level.
ARTICLE 2 - PRICES
The prices displayed on the site are in euros and include all applicable charges in Metropolitan France. VAT is applied at the rate in effect at the time of the order. The prices of the products do not include shipping costs.
ARTICLE 3 - AVAILABILITY
In case of temporary unavailability of a size, the internet user is notified by a message during the validation, under the description of the item.
In case of temporary unavailability of an item, a warning message is present on the product description along with the estimated restocking date.
In the case of ordering multiple products, if one of the products is found to be unavailable, the entire order will be processed and shipped only when all the products in that order are available. Boutique-Rugby.com will then inform the internet user of this additional delay. The user can choose to receive the available items of their order first. The internet user will then be charged only the shipping costs announced at the time of the order.
However, in case of permanent unavailability of an ordered product, Boutique-Rugby.com will take the following measures:
- Partial Shipment: When Boutique-Rugby.com proceeds with the partial shipment of the order due to the permanent unavailability of a product, the amount of the shipped products, along with the corresponding shipping costs, will be debited from the user's account at the time of purchase. At the same time, the amount of the unavailable products will be refunded to the same account.
- Exchange of Items: Another option is to offer an exchange of unavailable items for available items, provided that the total amount of the new items does not exceed that of the unavailable products. In this case, the replacement items will be shipped instead of the initially ordered unavailable items, and the delivery costs for this exchange will be covered by Boutique-Rugby.com.
ARTICLE 4 - DELIVERY
The products available on our site can only be delivered to the countries listed at the time of the order.

For products with a selling price exceeding €500 including VAT, the maximum delivery time is 3 months. For other products, we commit to making the delivery within a maximum period of one month. If you prefer to wait beyond this period, please inform us clearly. After this period, you have the right to request a refund for your order.

ARTICLE 5 - PAYMENT
The internet user can pay for their purchases by Visa, Mastercard, PayPal, or bank transfer.
Any delay in payment automatically incurs late payment interest equivalent to 1.5 times the current legal interest rate, applicable from the day of the payment demand.
ARTICLE 6 – PRODUCT RETURNS
In accordance with current legal provisions, the internet user has a withdrawal period of 14 days from the day of receipt of the order. However, Boutique-Rugby.com extends this period to 100 days.

The internet user can choose between a refund for the product or an exchange.
In case of a refund request, it will be processed within a maximum of 10 days. The return shipping costs are the responsibility of the customer. In general, all costs and risks associated with the return of the product are borne by the sender.
6.1 – Exchange
Regardless of the reason, the customer has 100 days to exchange their product for any item. Only products in perfect condition and in their original packaging are eligible for return. If the new product is more expensive than the old one, the customer will need to pay the difference before receiving the new product. If it is cheaper, Boutique Rugby will refund the difference or issue a credit note. In this case, the return shipping costs for the new product are also the responsibility of the customer.
6.2 - Non-compliant Item with the Order The internet user then has 72 hours upon receipt of the package to make a return request to Boutique-Rugby.com.
In this case, Boutique-Rugby.com will: - cover the necessary return costs, - ship at its own expense the product corresponding to the order within 10 days of receiving the returned product, subject to the availability of the requested product in stock.
If the ordered product is no longer available at the time of the return, Boutique-Rugby.com will then refund the missing product and the return shipping costs in the same manner as a right of withdrawal.
It is reminded that the Internet user is free to subscribe or not to insurance in case of loss, theft, or destruction of their package. Boutique-Rugby.com does not cover any of these costs and cannot be held responsible for the non-reception of the internet user's package.
Only products returned complete, in perfect condition, and in their original packaging will be accepted.
6.3 - Defective Item Due to the Carrier. The customer must check the condition of the package upon delivery and make all necessary reservations with the carrier in case of an open or damaged package, missing or damaged items. He must then transmit all these reservations to Boutique Rugby no later than 48 hours after receiving the package. Otherwise, no claim can be made by the Internet user to Boutique-Rugby.com.

ARTICLE 8 - RESPONSIBILITIES
The liability of Boutique-Rugby.com cannot be held in the event of a breach of one of the contractual obligations incumbent upon it due to a fortuitous event or a case of force majeure as defined by French jurisprudence.
In no event shall the liability of Boutique-Rugby.com be incurred for loss of profits, business losses, loss of data, or loss of earnings, or any other indirect or unforeseeable damage at the time of using the site or concluding the sales contract between the Parties.
The liability of Boutique-Rugby.com shall not be incurred for any immaterial or bodily harm that may result from the improper use of the products marketed.
The liability of Boutique-Rugby.com shall not be incurred for any damages inherent to the use of the internet network (interruption, virus). The internet user is responsible for the quality of the information regarding their delivery address, email, and phone number provided during the order.
